We are delighted to welcome you to Esmeralda Beach Resort. Please review these Terms & Conditions carefully, as they apply to your reservation and stay.
FRONT DESK
Our office hours are 7:00 a.m. to 11:00 p.m. daily. If you plan to arrive outside these hours, please notify us in advance so arrangements can be made.
RESERVATIONS
All reservations are subject to approval by Management and the property owner. The Administrator will review the reservation before any payment is processed. The full reservation amount will be charged only after the Administrator has reviewed and approved the reservation. If an issue with your reservation is identified, you will be contacted within 48 hours of booking.
Published rates may change without notice, but rate updates do not change the price of an already confirmed reservation. Rescheduled reservations are subject to the pricing terms under Reservation Adjustments and Rebooking. Coupons and promotional discounts must be applied at the time of booking.
The resort is still under construction, and daytime construction noise may occur.
GUEST INFORMATION
Please provide the exact number of adults and children when booking. Rates depend on the number of registered guests, and any approved adjustments may result in additional charges.
All occupants must be registered. Additional guests must be approved by Management and any applicable charges paid before they enter the property. The maximum authorized occupancy may never be exceeded.
PROPERTY
The Guest rents the furnished property and its improvements for vacation purposes only.
ARRIVAL AND DEPARTURE
The reservation holder must be personally present at check-in and provide valid identification.
Check-in begins at 4:00 p.m. Check-out is by 11:00 a.m. All times and deadlines in this document use Arizona time (UTC-7), a fixed offset year-round. Arrivals outside Front Desk hours must be arranged in advance.
PAYMENTS
A valid payment method must be provided at the time of booking. Full payment of the total reservation amount will be processed after the Administrator has reviewed and approved the reservation. No payment will be processed before that review and approval.
We accept VISA and MASTERCARD. Exchange rates between U.S. dollars and Mexican pesos are subject to change.
CANCELLATIONS AND REFUNDS
The following policy applies to reservations booked directly with us, subject to the exceptions below.
STANDARD RESERVATIONS INITIAL 24 HOUR PERIOD
Standard reservations may be canceled less than 24 hours after the original booking for a full refund.
This full-refund provision does not apply to discounted, promotional, coupon, or holiday reservations, or to cancellations made solely to create a new reservation using a coupon.
STANDARD RESERVATIONS AFTER THE INITIAL 24 HOUR PERIOD
- 15 or more calendar days before arrival: A $300.00 USD cancellation fee applies. Any remaining amount paid will be refunded. The cancellation fee will not exceed the total amount paid.
- 8 to 14 calendar days before arrival: 50% of the total reservation amount will be refunded. The remaining 50% will be retained as a cancellation fee.
- 7 calendar days or fewer before arrival: The reservation is non-refundable.
No refunds will be issued for early departures or no-shows.
For cancellation and reservation-change deadlines expressed in calendar days before arrival, the cutoff time is 9:00 a.m. Arizona time (UTC-7) on the applicable deadline date. The initial 24-hour period is measured from the time of the original booking.
Cancellation and reservation-change requests may be submitted by email, WhatsApp, or telephone. All requests must be confirmed by Management by email.
DISCOUNTED PROMOTIONAL AND HOLIDAY RESERVATIONS
Reservations booked with any discount, promotional rate, or coupon, as well as reservations for holiday dates, are non-refundable from the time of booking.
For purposes of this policy, holiday dates include official holidays in the United States and Mexico for the calendar year of the stay, as well as vacation periods. The applicable holiday dates and the start and end dates of vacation periods are defined in the Rates table of each property listing on our website at the time of booking.
If a reservation includes even one night on an official holiday or within a vacation period, the entire reservation is non-refundable, not only that night.
The 24-hour full-refund provision does not apply to these reservations.
Guests may request one adjustment within the first 24 hours after the original booking without a rebooking fee, subject to availability, the condominium-type restriction, and the pricing terms under Reservation Adjustments and Rebooking. This adjustment does not change the reservation’s non-refundable status or restart the 24-hour adjustment period.
After the initial 24-hour period, the standard rebooking terms and fees apply. The reservation remains non-refundable.
COUPONS AND RETROACTIVE DISCOUNTS
Discount coupons must be applied at the time of booking and cannot be added retroactively. An existing reservation cannot be modified solely to add a coupon that was not applied when it was made.
If a Guest cancels a reservation made without a coupon in order to create a new reservation using a coupon, a $300.00 USD cancellation fee will apply to the original reservation, including during the first 24 hours after booking.
This fee is the cancellation penalty for the original reservation, not an additional coupon application fee. Reservations that are already non-refundable remain non-refundable.
RESERVATION ADJUSTMENTS AND REBOOKING
PRICING FOR RESCHEDULED RESERVATIONS
When a reservation is rescheduled, the original accommodation price will be maintained if the new dates have the same or a lower price. No price reduction or refund of the difference will be provided for lower-priced dates. If the new dates have a higher price, the Guest must pay the increase over the original accommodation price, plus the applicable rebooking fee. The rebooking fee is waived for one adjustment requested within the initial 24-hour period, as described below.
INITIAL 24 HOUR ADJUSTMENT PERIOD
Guests may request one adjustment to their reservation dates or condominium type within the first 24 hours after the original booking without a rebooking fee. This complimentary adjustment does not count toward the maximum of three rebooking changes.
The 30-day rescheduling limit does not apply to this one complimentary adjustment. The new dates may be more than 30 calendar days after the original scheduled arrival date.
All adjustments are subject to availability and the pricing terms above.
For standard reservations, the one complimentary adjustment requested within the first 24 hours, including a change of condominium type, does not make the reservation non-refundable. The standard cancellation and refund policy continues to apply.
Changing the condominium type may change the accommodation price. Management will communicate the updated price before confirming the change. A price adjustment resulting from a condominium-type change within the initial 24-hour period does not, by itself, make a standard reservation non-refundable.
Discounted, promotional, coupon, and holiday reservations remain non-refundable, including when adjusted during the initial 24-hour period.
An adjustment does not restart or extend the original 24-hour adjustment or full-refund period.
DEADLINE FOR RESERVATION CHANGES
Requests to change reservation dates or condominium type must be submitted no later than 9:00 a.m. Arizona time (UTC-7), 8 calendar days before the scheduled arrival date. Changes are not permitted after this deadline, including when 7 calendar days or fewer remain before arrival. This advance-notice requirement also applies to the one complimentary adjustment within the initial 24-hour period.
CHANGES AFTER THE INITIAL 24 HOUR PERIOD
- A maximum of three rebooking changes per reservation is permitted, in addition to the one complimentary adjustment allowed within the initial 24-hour period.
- A $35.00 USD rebooking fee applies to each change.
- All changes are subject to availability and the pricing terms above. Any increase for higher-priced dates is charged in addition to the $35.00 USD rebooking fee.
- Except for the one complimentary adjustment within the initial 24-hour period, the new arrival date must fall within the 30 calendar days following the original scheduled arrival date. The new departure date may fall after this 30-day period.
- The original scheduled arrival date remains the reference date for this 30-day limit. Subsequent changes do not restart or extend it.
- Once a change to the arrival date, departure date, or condominium type is confirmed after the initial 24-hour period, the reservation becomes non-refundable. This also applies when only the condominium type changes and the stay dates remain the same. The standard cancellation refund schedule no longer applies.
For a condominium-type change after the initial 24-hour period, the accommodation price may change according to the selected condominium, and the applicable rebooking fee will apply. Reservations that were already non-refundable remain non-refundable.
CANCELLATION BY MANAGEMENT
Management reserves the right to cancel an approved reservation if the required full payment cannot be processed after the Administrator’s review and approval.
THIRD PARTY AND AFFILIATE RESERVATIONS
For reservations made through Booking.com, Vrbo, Expedia, Hotels.com, or another third-party platform or affiliate, the payment, cancellation, refund, and reservation-change terms accepted through that booking channel apply.
Guests must still comply with the property’s occupancy limits, conduct requirements, and other rules governing their stay.
UNAVAILABILITY
A unit is considered out of service and unavailable when equipment or system failures, damage, or unforeseen circumstances prevent its use for the reserved stay or prevent safe occupancy. Minor defects or temporary service interruptions do not, by themselves, make a unit unavailable unless they prevent its use or safe occupancy.
If the reserved unit is out of service and another unit with the same characteristics is available, Management will transfer the reservation to that unit. In that case, the reservation will continue in the replacement unit, and the substitution will not entitle the Guest to a cancellation refund. If no replacement unit with the same characteristics is available, Management will cancel the reservation and refund all payments made by the Guest.
This full-refund provision also applies to discounted, promotional, coupon, holiday, vacation-period, and rebooked reservations, regardless of their otherwise non-refundable status.
Temporary service interruptions that do not prevent use of the unit or safe occupancy are addressed under the applicable service, system failure, and force majeure provisions below.
STRICT NOISE POLICY
Excessive noise, disruptive music, parties, and disturbances to neighboring guests are prohibited.
Quiet hours are from 10:00 p.m. to 8:00 a.m. Loud vehicles are also prohibited during these hours.
Failure to comply may result in fines and eviction.
APPROVED GUESTS AND OCCUPANCY
The premises are for the personal vacation use of registered and approved guests only. The reservation holder is responsible for the conduct of everyone occupying the property during the stay.
Each unit has its own maximum occupancy, regardless of the number of bedrooms. The maximum number of permitted guests is specified in that unit’s property listing description and must not be exceeded at any time.
The Administrator reserves the right to deny admission to additional persons who have not been approved or whose admission would exceed the unit’s maximum occupancy.
Persons beyond the number registered in the reservation may be admitted only with the Administrator’s approval and only within the unit’s published maximum occupancy. Additional charges may apply as determined by the Administrator. Payment of an additional charge does not authorize occupancy above the published maximum.
A sofa bed provides sleeping flexibility within the authorized occupancy. It does not increase the maximum number of permitted guests.
Any increase in the registered guest count requires Management’s approval, registration, and payment of applicable charges before the additional guests enter the property.
Exceeding the maximum authorized occupancy may result in immediate eviction without a refund.
SECURITY DEPOSIT
A $200.00 USD security deposit is required at arrival and may be provided in cash or by credit card authorization.
The security deposit is used to cover damage to the property and its contents, including missing items. If the cost of damage exceeds the available deposit, the Guest authorizes Management to charge the outstanding balance to the credit card on file or to reauthorize the deposit amount to cover the remaining damage costs. The deposit does not limit the Guest’s responsibility for the damage caused.
The deposit is subject to inspection of the unit after departure. If no damage or missing items are found, Management will return the full cash deposit or release the full credit card authorization at 2:00 p.m. Arizona time (UTC-7) on the departure date. Management releases the credit card authorization on the day of departure; the time required for the funds to become available again depends on the card issuer. If damage or missing items are found, applicable charges will be deducted and any remaining deposit balance will be returned or released.
Deductions may apply for missing kitchenware, linens, decorations, or property damage.
Charges for damage and missing items are determined using the inventory price lists for the unit and repair or replacement estimates, as applicable.
CLEANING
The premises will be delivered in a professionally cleaned condition.
If the Guest’s use requires cleaning beyond regular turnover services, the Guest will be responsible for the additional cleaning costs.
PETS
Pets are not allowed.
If an unauthorized pet is discovered on the premises, the Guest may be required to leave without a refund for breach of this agreement.
NO SMOKING
Smoking is prohibited on the premises.
The Guest is responsible for all smoking-related damage and cleaning costs, including stains, burns, odors, and debris removal. Violations may result in immediate eviction.
CONDITION OF PREMISES
Upon arrival, the Guest must inspect the premises, furniture, furnishings, appliances, and fixtures and promptly report any damage, malfunction, or unsatisfactory condition to Management in writing.
Reporting a repair or maintenance issue does not, by itself, entitle the Guest to cancel the reservation or receive a refund. If the premises become unavailable, the Unavailability provision applies.
LOST OR LEFT ITEMS
Management assumes no responsibility for lost, stolen, or abandoned items.
Reasonable efforts will be made to contact the Guest regarding found items. Items returned at the Guest’s request are subject to a $20.00 USD handling charge plus shipping costs.
Management is not responsible for the condition of returned items. Items unclaimed for more than 30 days may be donated or sold.
NO PARTIES
The premises may not be used for weddings, receptions, parties, or large gatherings.
Parties and disruptive gatherings may result in eviction without a refund of the rental payment. The security deposit is used to cover damage and missing items; it is not automatically forfeited because of a party. If the deposit is insufficient, the payment authorization provisions under Security Deposit apply.
ILLEGAL SUBSTANCES
Illegal substances are prohibited. Minors may not possess alcohol.
Violations will result in eviction without a refund.
TV CABLE INTERNET AND SATELLITE
These services are provided as a convenience.
No refunds will be issued for temporary outages, the number of available devices, programming, lack of content, speed, access problems, unfamiliarity with operation, or personal preferences regarding these services.
AIR CONDITIONING AND HEATING
All units are equipped with air conditioning. The Guest agrees to operate the air conditioning and any heating equipment properly.
Unless otherwise instructed:
- Air conditioning must not be set below 72°F.
- Heating must not be set above 78°F.
- The fan setting must remain on “Auto.”
Doors and windows must remain closed while air conditioning or heating is operating.
Malfunctions must be reported promptly to Management. Temporary HVAC interruptions that do not prevent use of the unit or safe occupancy do not qualify for a refund. If the premises become unavailable, the Unavailability provision applies.
SYSTEM FAILURES
Failures involving water, sewer, electricity, gas, plumbing, appliances, ventilation, heating, cooling, pools, hot tubs, or other equipment must be reported promptly.
Management will make reasonable efforts to arrange repairs or replacement. The Guest must allow reasonable access for inspection and necessary work.
Temporary system failures or service interruptions that do not prevent use of the unit or safe occupancy do not qualify for a refund or compensation under this agreement. If the premises become unavailable, the Unavailability provision applies.
INDIVIDUALLY OWNED CONDOMINIUMS
The condominiums we manage are individually owned and furnished according to each owner’s preferences and Management’s quality standards.
Furniture, décor, and equipment may vary by unit. Please notify Management if the accommodation does not meet your requirements.
Personal preferences regarding furnishings or décor do not qualify for a refund.
RULES AND REGULATIONS AND NO COMMERCIAL USE
Guests must comply with property rules and regulations posted on the premises or provided by Management.
Guests may not disturb, annoy, endanger, or interfere with other guests or neighbors.
Commercial activities, unlawful activities, illicit drugs, contraband, property damage, and conduct creating a nuisance are prohibited.
The reservation holder is responsible for ensuring that all members of the reservation comply with these requirements.
MAINTENANCE AND REPORTING
Guests must properly use and safeguard the premises, furniture, furnishings, appliances, and mechanical, electrical, gas, and plumbing fixtures.
The premises must be kept reasonably clean and sanitary.
Guests must promptly notify Management of any problem, malfunction, or damage.
Guests are responsible for repairs or replacements resulting from their actions or misuse, excluding ordinary wear and tear. Guests are also responsible for additional damage caused by failing to report a problem promptly.
ENTRY
Management and its authorized representatives may enter the premises to perform necessary repairs, maintenance, inspections, or agreed services, or to verify compliance with this agreement.
For non-emergency repairs, maintenance, inspections, or services, Management will notify the Guest in advance and coordinate the time of entry. The Guest must allow reasonable access for these purposes.
In an emergency requiring immediate action to protect persons or property, Management and its authorized representatives may enter without prior notice, including when the Guest is absent. Management will notify the Guest as soon as practicable.
At least 24 hours’ notice will be provided for access to show the premises to prospective or actual purchasers, tenants, lenders, appraisers, or contractors.
TOWEL SUPPLY
Condominium towels are provided for use inside the unit and will not be replaced during the stay.
Towels must not be removed from the condominium. Please bring your own beach and pool towels.
FORCE MAJEURE
Management cannot control weather, storms, utility-provider outages, municipal water shortages, acts of nature, or other events beyond its control that may affect travel or the Guest’s stay.
Such events do not, by themselves, qualify for a refund when the accommodation remains available for use and safe occupancy.
If Management cannot provide the reserved premises or a replacement unit with the same characteristics, the Unavailability provision applies.
